{"id":4411,"date":"2020-02-04T15:45:00","date_gmt":"2020-02-04T20:45:00","guid":{"rendered":"http:\/\/vps7961.inmotionhosting.com\/~copyrightlaws\/?p=4411"},"modified":"2026-07-03T14:25:17","modified_gmt":"2026-07-03T14:25:17","slug":"beijing-treaty-audiovisual-performances","status":"publish","type":"post","link":"https:\/\/copyrightlaws.com\/?p=4411","title":{"rendered":"Beijing Treaty on Audiovisual Performances"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/copyrightlaws.com\/wp-content\/uploads\/2017\/10\/Article-Beijing-Treaty-on-av-performances-Post.png\"><br><\/a>The Beijing Treaty on Audiovisual Performances protects performers in audiovisual performances such as films, TV series and musicals.<\/p>\n\n\n\n<h2 id=\"h-the-beijing-treaty-on-audiovisual-performances\" class=\"wp-block-heading\">The Beijing Treaty on Audiovisual Performances<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As of 2012, performers in audiovisual works have a treaty of their own, and it has now entered into force as of 28 April 2020 (see below).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 26 June 2012, a Diplomatic Conference under the auspices of the World Intellectual Property Organization (WIPO) finalized a new copyright treaty. Negotiators from WIPO member states, including the U.S., signed the Beijing Treaty on Audiovisual Performances (Beijing Treaty).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The treaty was named in recognition of the city of Beijing, which hosted the final round of negotiations from 20 to 26 June 2012. This concluded over 12 years of negotiations.<\/p>\n\n\n\n<h2 id=\"h-what-the-beijing-treaty-covers\" class=\"wp-block-heading\">What the Beijing Treaty Covers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Beijing Treaty protects the rights of performers in audiovisual works such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Films<\/li>\n\n\n\n<li>TV series<\/li>\n\n\n\n<li>Musicals<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Beijing Treaty provides performers with four kinds economic rights for performances fixed in audiovisual fixations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reproduction<\/li>\n\n\n\n<li>Distribution<\/li>\n\n\n\n<li>Rental<\/li>\n\n\n\n<li>Making available<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For live performances, performers have the rights of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Broadcasting<\/li>\n\n\n\n<li>Communication to the public<\/li>\n\n\n\n<li>Fixation<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Beijing Treaty also grants performers&nbsp;<a href=\"https:\/\/copyrightlaws.com\/moral-rights-in-u-s-copyright-law\/\">moral rights<\/a>. These are the rights&nbsp;to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Be identified as the performer<\/li>\n\n\n\n<li>Object to any distortion, mutilation or other modification prejudical to the performer&#8217;s reputation<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These new rights must last at least 50 years in member countries. Test your <a href=\"https:\/\/copyrightlaws.com\/quiz\/international-copyright-law-quiz-6\/\">international copyright law knowledge here<\/a>.<\/p>\n\n\n\n<h2 id=\"h-when-will-the-new-copyright-treaty-take-effect\" class=\"wp-block-heading\">When Will the New Copyright Treaty Take Effect?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">With the ratification of Indonesia on 28 January 2020, the <a href=\"https:\/\/www.wipo.int\/pressroom\/en\/articles\/2020\/article_0009.html\" target=\"_blank\" rel=\"noreferrer noopener\">Beijing Treaty entered into force<\/a> for its 30 contracting parties on 28 April 2020.&nbsp; You can check for updates to the contracting parties to the treaty&nbsp;<a href=\"http:\/\/www.wipo.int\/treaties\/en\/ShowResults.jsp?lang=en&amp;treaty_id=841\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n\n\n\n<h2 id=\"h-the-importance-of-a-new-treaty-as-illustrated-by-the-berne-copyright-treaty\" class=\"wp-block-heading\">The Importance of a New Treaty as Illustrated by the Berne Copyright Treaty<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A new copyright (or copyright-related) treaty is a big deal. <a href=\"https:\/\/www.wipo.int\/treaties\/en\/ip\/berne\/\" target=\"_blank\" rel=\"noopener noreferrer\">The Berne Convention<\/a> is evidence of this. Berne came into force in 1886 and is still in effect. With its revisions, Berne remains the leading copyright treaty, setting minimum international copyright standards in the 181 member states currently adhering to it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The number of Berne members changes from time to time.
